Reward pay for security guards who prevent incidents of senior officials

At today's meeting of the Council of Ministers, the government has approved a reward for the guards who prevent incidents of high officials.
This decision aims to determine the financial treatment procedures for the employees of the Guard of the Republic of Albania in cases of family disasters, the reward for the results achieved and the serious damage to private property due to duty.
Decision:
In support of Article 100 of the Constitution and the letters "c", "ç" and "d", point 2, Article 48, of Law No. 33/2021, "On the Guard of the Republic of Albania", as amended, with the proposal of the Minister of the Interior, the Council of Ministers
DECIDE:
GENERAL PROVISIONS
This decision aims to determine the financial treatment procedures for the employees of the Guard of the Republic of Albania in cases of family disasters, the reward for the results achieved and the serious damage to private property due to duty, in accordance with the letters "c" , "ç" and "d", point 2, article 48, of law no. 33/2021, "On the Guard of the Republic of Albania", as amended.
FINANCIAL ASSISTANCE IN CASE OF DISASTERS IN THE FAMILY
As a result of this decision, a family disaster is considered the death of a dependent parent, spouse or child.
Financial assistance for family disasters is given in the amount of 2 (two) net monthly salaries of the last month.
To be treated with financial assistance according to point 2 of this chapter, the employee submits to the Guard of the Republic:
a) written request;
b) the death certificate of the dependent parent, spouse or child;
c) family certificate.
Payment for immediate financial assistance for family disasters is made by order of the General Director.
III. REWARD OF THE EMPLOYEE OF THE REPUBLIC GUARD
The employee of the Guard of the Republic receives a reward up to 3 (three) monthly net salaries per year for high results achieved during the performance of the duty. The award is given based on these criteria:
a) Punonjësi pëson dëmtime shëndetësore gjatë shërbimit për sigurimin e personaliteteve apo të objekteve në ruajtje, duke përfshirë raste, si: sulme të dhunshme, aksidente gjatë detyrës ose situata emergjente, që shkaktojnë paaftësi të përkohshme në punë për më shumë se 14 (katërmbëdhjetë) ditë kalendarike;
b) Parandalohet një incident i rëndë apo përpjekje për dëmtim fizik të personaliteteve me masa konkrete dhe ndërhyrje të menjëhershme të punonjësit të Gardës;
c) Kryhen shërbime për sigurinë e personaliteteve dhe të objekteve në kushte të rrezikshme, si: gjatë protestave masive, kërcënimeve terroriste të konfirmuara, situatave të tensionuara me rrezik ose detyra të përshkallëzuara papritur, që kërkojnë vigjilencë të lartë dhe aftësi të shpejta reagimi;
ç) Punonjësi kryen detyra sigurie në aktivitete madhore, ku marrin pjesë më shumë se 10 (dhjetë) personalitete të rëndësishme vendase dhe ndërkombëtare, si: samite të nivelit të lartë, takime ndërkombëtare ose ceremoni shtetërore me rëndësi kombëtare e ndërkombëtare.
Masa e shpërblimit jepet e përshkallëzuar sipas klasifikimit:
a) 3 (tri) paga mujore neto, për plotësimin e kriterit të shkronjës “a”, të pikës 1, të këtij kreu;
b) 2 (dy) paga mujore neto, për plotësimin e kriterit të shkronjave “b” dhe “c”, të pikës 1, të këtij kreu;
c) 1 (një) pagë mujore neto, për plotësimin e kriterit të shkronjës “ç”, të pikës 1, të këtij kreu.
NDIHMA E MENJËHERSHME FINANCIARE NË RAST TË DËMTIMIT TË RËNDË TË PRONËS PËR SHKAK TË DETYRËS
Punonjësi i Gardës së Republikës, në rast të dëmtimit të rëndë të pronës private për shkak të detyrës, përfiton ndihmë të menjëhershme financiare, sipas akteve të vlerësimit të dëmit, por jo më shumë se 1 000 000 (një milion) lekë.
Punonjësi e përfiton ndihmën e menjëhershme financiare kur:
a) prona i është dëmtuar si pasojë e veprës penale, e kryer në dëm të punonjësit për shkak të detyrës, si dhe rasti është paraqitur pranë organeve ligjzbatuese;
b) disponon dokument, që vërteton pronësinë e pronës së dëmtuar;
c) nuk ka përfituar dëmshpërblim nga një shoqëri sigurimi për dëmtimin e pronës.
PROCEDURA PËR SHQYRTIMIN E PROPOZIMIT PËR SHPËRBLIM DHE NDIHMË TË MENJËHERSHME FINANCIARE
Drejtori i Përgjithshëm i Gardës urdhëron ngritjen e komisionit të posaçëm, sipas rasteve të parashikuara në krerët III dhe IV, të këtij vendimi.
Komisioni i posaçëm ka në përbërjen e tij 5 (pesë) anëtarë:
a) Zëvendësdrejtorin e Përgjithshëm i Gardës;
b) Drejtorin e Drejtorisë së Shërbimeve Mbështetëse;
c) Shefin e sektorit të buxhet – financës;
ç) Shefin e sektorit të burimeve njerëzore;
d) Një punonjës me profil jurist.
The direct superior and the highest in the hierarchy presents to the special commission the proposal for remuneration, accompanied by an explanatory report of the concrete results achieved by the employee, according to the criteria defined in points 1 and 2, of chapter III, of this decision.
The payment for the remuneration of the employee is made by order of the General Director, according to the decision of the special commission.
In cases of serious damage to property, provided for in points 1 and 2, of chapter IV, of this decision, the commission meets and carries out verifications and relevant assessments, no later than 10 (ten) working days from the day of submission of the request of the employee.
To benefit from immediate financial assistance, the employee submits the following documentation:
a) The written request for the benefit of compensation, presenting the fact of the damage;
b) Copy of the letter for referring the criminal offense to the law enforcement bodies;
c) The notarized copy of the document proving the ownership of the damaged property;
ç) The damage assessment act by a licensed expert.
Payment for immediate financial assistance for the damage caused is made by order of the General Director, according to the decision of the special commission.
When the investigation or trial of the case proves that the damage caused was not due to the duty, the employee, who benefited from immediate financial assistance, is obliged to return 100 (one hundred) % of the benefited amount.
In case of disagreement on the proposal for remuneration of the employee or the provision of immediate financial assistance, the employee appeals the decision of the special commission to the General Director of the Guard.
The General Director of the Guard of the Republic decides on the acceptance or rejection of the employee's appeal. In case of acceptance of the appeal, the proposal for remuneration of the employee or provision of immediate financial assistance is returned for reconsideration in the special commission.
FINAL PROVISIONS
The financial effects, resulting from the implementation of this decision, are borne by the budget approved for the Ministry of the Interior in the "Guard of the Republic" budget program.
The Ministry of the Interior and the Guard of the Republic of Albania are charged with the implementation of this decision.
This decision enters into force upon publication in the "Official Gazette" and takes effect on January 1, 2025.
